CONSERVATION COMMISSION
Town of Monterey, Massachusetts
MEETING DATE: July 12, 2010
Present: Richard Andrus, Timothy Lovett, and Christopher Blair
The meeting convened at 6:20p.m. (the room was occupied which delayed the start of meeting)
Kirby – RDA – 58 Cronk Rd. – replace 2 decks s (Rick Andrus is the project manager)
Timothy and Raymond Kirby were present to review the project. The project was approved as submitted as a N2.
Fitzpatrick – 39 Tyringham Rd – RDA continued from a previous meeting
The Commission discussed this project and the fact that no one has shown up to present the project. Originally Steve Sedden (contractor) was supposed to come when it was filed but he and the homeowner had a dispute on the cost of the project and she called Town Hall and told Melissa she was looking for another, less expensive contractor.~ Melissa explained this was no problem and that the Commission would just continue the hearing until she found a new contractor who could come in and explain the project and any changes he might make.~ She was clear on this.~ When the agenda was emailed last week she emailed Melissa saying to take her off and Melissa explained that she would need to send a letter to the Commission stating she was no longer going forward with the project and then they would close the hearing and take
it off the agenda.~ Apparently this did not happen and somehow she got a building permit.~ Don Torrico will be notified that Con Comm had not signed off on this.
For Discussion:
1. Mail was reviewed.
2. Minutes from June 14th were approved as written.
3. The Commission renewed their membership to the Berkshire Natural Resources Council, INC and the Massachusetts Association of Conservation Commissions.
4. The Commission agreed to send a letter to Joanne Simms regarding the lots she owns on Old Beartown Mtn Rd, specifically the 2 lots abutting the forest and inform her that those 2 lots fall within the Scenic Mountain Act Region because they are at or above 1500ft in elevation.
5. The Commission reviewed the KSA special permit application and determined that as long as the trailer is not within 100ft of the lake it is not within their jurisdiction.
